These Terms of Use coexist with our privacy policy and together these If you do not agree to all our terms of use, please do not use the website. If you do use the website, your conduct indicates that you agree to be bound by the terms.

Unless otherwise specified the copyright in the contents of all pages on the site are owned or licensed to Marbella Body Contouring SL.

As such you are prohibited from copying, uploading, posting, modifying or distributing any material from this site in any way, except that you may download one copy of the materials on any single computer for your personal, home use only provided you keep intact all copyright and other proprietary notices. 

Further you may not provide a link to our site from any other site without first obtaining our prior written consent.

This is a free “public access” website and as such it is a condition of any use of the site and the materials that it is at the user’s own risk.

Neither Marbella Body Contouring SL, nor any of the site’s technical staff or administrators, editors or contributors shall be liable for any loss or damage suffered as a result of any use of the site or inability to use the site including but not limited to direct losses, consequential loss and loss of any profits.

This site acts solely as a marketing and sales website to attract the business of prospective customers and as such, the owners and marketing professionals of the site are unable to provide medical advice. Any treatment chosen by you shall be at your sole discretion. 

Information contained on this site does not form the basis of any contract.

AVAILABILITY OF SERVICE 

We will endeavour to make this website constantly accessible for your use, it does not warrant or guarantee that the website will be uninterrupted or error–free at any time.

We make no warranty that this site is free from computer viruses or any other malicious or impairing computer program. The pages contained on this site may contain technical inaccuracies and typographical errors. We accept no responsibility for keeping the information in these pages up-to-date or liability for any failure to do so. Please note that any software is downloaded at your own risk.

PASSWORDS 

Passwords must not be disclosed to any person. If you become aware of any unauthorised disclosure of a password, then you must notify us immediately. You will remain liable for all activities carried out under access with your password unless and until you have notified us of a password breach.

If any term, condition or provision of these terms is determined to be unlawful, invalid, void or for any reason unenforceable, the validity and enforceability of the remaining terms, conditions and provisions shall not in any way be affected or impaired thereby.

JURISDICTION 

These terms shall be governed by and construed in accordance with Spanish law and subject to the exclusion jurisdiction of the Spanish Courts.

TERMS & CONDITIONS OF BOOKINGS, TREATMENTS & GIFT CARDS

Set out below are the terms on which Marbella Body Contouring SL provides service to its clients. Please ensure that you have read and fully understood them prior to booking any treatment.

APPOINTMENTS, DEPOSITS & CANCELLATIONS 

Appointments must be booked via our appointment system.

A fully refundable deposit of 50 euros is required for all bookings (except for free consultations). 

The only circumstances a deposit will not be refunded will be if you fail to turn up for your appointment. 

If you are unable to attend your appointment, please contact us as soon as possible on + 34 627159 460.

Any refunds due will be processed within 28 working days.

Treatments forming part of a package can be cancelled or re-scheduled. Failure to turn up will result in the treatment being redeemed by us, with no refund being available for that element of the package.

We reserve the right to cancel or postpone a consultation or treatment, if we are unable to provide the treatment due to staff illness or you present with what appears to be fever or other symptoms.

ARRIVAL FOR YOUR APPOINTMENT 

Please arrive 5 minutes before your appointment and wait in the General reception area. 

Please cleanse the area to be treated -i.e. for facial treatments please arrive wearing no make-up or moisturisers and for body treatments please ensure you have showered and you have not applied any creams.  

TREATMENT PACKAGES 

All treatments purchased as a package must be paid in full in advance of the first treatment. All treatment packages must be performed within 14 months of the date of purchase; any treatments not performed within 14 months will be forfeited, with no refund available. 

Treatment packages are only refundable for medical reasons and require medical confirmation from a medical professional. 

Any applicable refunds will be processed within 28 working days.

TREATMENT SUITABILITY 

You must complete a medical questionnaire prior to your treatment(s). It is your responsibility to ensure that you provide us with all the relevant medical details prior to your treatment and to inform us of any changes since completing the questionnaire.

Treatments cannot be performed on anyone under the age of 18.

THERAPISTS

Our therapists are trained in using our equipment competently and safely. 

Our therapists are not medically qualified and will not be able to provide medical advice. 

Our therapists can advise you as to the likely results achievable from our equipment based on clinical studies and customer use.  

LIABILITY

We will not be liable in contract, tort or otherwise for any economic loss (including, without limitation, loss of profit), or for any other special, indirect or consequential loss or damage arising out of, or in connection with, its provision of any goods and/or services to you.

You will be required to read and sign an applicable consent form prior to treatment. We are unable to provide any treatment without your written consent.

We will not be liable for any damage that occurs as a result of the client’s failure to disclose relevant medical details.

You agree to comply with all instructions and/or recommendations given to you by us, regarding the care of a treated area.

GIFT CARDS

Gift cards can be redeemed against any treatment. In the event the gift card value exceeds the treatment value. A gift card for the residual amount will be issued by us. 

Gift cards must be used within12 months of purchase. 

COMPLAINTS 

We strive to provide our patients with the best service possible, and your feedback allows us to address any concerns that you may have and improve our service. If you are unhappy with any part of our service, please let us know by sending an email to complaints@marbellabodycontouring.com.

You can speak with a member of staff involved in your treatment. If you do this, we can try to resolve your complaint there and then. 

If you agree to someone making the complaint on your behalf, it is important that you know that we will need to ask for your permission for us to deal with that person.

Please note we may need to make enquiries before we can respond to your complaint and if that is the case they will keep you updated on this.

We will investigate your complaint and will aim to reply to you within 20 working days. We may contact you for more information or to discuss your complaint during this time.

In some cases, we may need more time to investigate your complaint and reply to you. If that is the case, we will let you know and provide a timeframe within which you can expect to receive a response from us.
